Evolución de la normativa penal española respecto a la vulneración de derechos de propiedad intelectual en internet

RESUMEN: 

El presente artículo pretende realizar un análisis de la evolución que ha sufrido la normativa penal española desde la aparición de Internet, en su intento por dar respuesta a las distintas conductas vulneradoras de los derechos de autor. Para ello se analizan tanto los cambios normativos del Código Penal, como aquellos cambios en la Ley de Propiedad Intelectual que tienen incidencia en la calificación de los tipos delictivos. Además, se realiza la calificación jurídica de las principales conductas vulneradoras bajo cada uno de dichos cambios normativos, de modo que se pueda contrastar su incidencia y efectividad.

ABSTRACT:

This article aims to carry out an analysis of the evolution that Spanish criminal law has undergone since the appearance of the Internet, in its attempt to respond to the different behaviors that violate copyright. For this, both the normative changes of the Penal Code are analyzed, as well as those changes in the Intellectual Property Law that have an impact on the classification of the criminal types. In addition, the legal classification of the main infringing behaviors is carried out under each of said regulatory changes, so that their incidence and effectiveness can be verified.
