RESUMEN: 

El presente trabajo pretende mostrar una visión general de la influencia que el nacionalismo periférico (fundamentalmente el catalán y, en parte, el vasco) y el nacionalismo centralista ha tenido en la configuración del Poder Judicial, la Administración de Justicia y el Ordenamiento Jurídico en España, desde la creación del Estado Moderno con la llegada al trono de los Borbones (es decir, Felipe V y sus Decretos de Nueva Planta) hasta nuestros días. Se estudiará cómo el Estado siempre ha pretendido tener centralizada la Justicia y los nacionalismos periféricos han intentado, unas veces con más coraje y otras más tímidamente, tomar competencias en una materia altamente sensible y que formaría parte del «núcleo duro» de soberanía, concluyendo con una visión de la situación actual bajo la influencia de la Constitución de 1978.

"The influence of nationalism on the Judiciary and the Administration of Justice in Spain"

ABSTRACT: 

The present work aims to show a general vision of the influence that peripheral nationalism (mainly catalan and, in part, basque) and centralist nationalism has had on the configuration of the Judiciary, the Administration of Justice and the Legal System in Spain, from the creation of the Modern State with the arrival to the throne of the Bourbons (that is, Felipe V and his «de Nueva Planta» Decrees) to the present day. It will be studied how the State has always tried to have centralized Justice and peripheral nationalisms have tried, sometimes with more courage and others more timidly, to take responsibility in a highly sensitive matter that would be part of the “hard core” of sovereignty, concluding with a vision of the current situation under the influence of the Constitution of 1978.
