La evolución legislativa de la Unión Europea en materia de patrimonio cultural. ¿Cambios a la luz del Horizonte Europa y Agenda 2030?

RESUMEN: 

La Comunidad Económica Europea, constituida en 1957 gracias al Tratado de Roma, y antecesora de lo que hoy conocemos como Unión Europea, se fundó para la consecución de una serie de objetivos políticos y sobre todo económicos, relegando los objetivos culturales a lo que legislaran los organismos internacionales. Actualmente parece ser que nada ha cambiado, pues las constantes crisis que acechan a la Unión —la última, causada por la pandemia del Covid-19— parecen confirmar el modelo funcionalista que rige la UE, subordinando la capacidad de crear lazos identitarios comunes a los intereses económicos inmediatos. A través de este artículo se mostrará el recorrido legislativo en materia de patrimonio y cultura de la UE, donde quedarán patentes las palabras recientemente referenciadas, al tiempo que se planteará si el nuevo horizonte 2020-2030 se presenta como una oportunidad legislativa para corregir esa corriente económica proteccionista.

"The legislative evolution of the European Union in the field of cultural heritage: Changes under the Europe Horizon and Agenda 2030?"

ABSTRACT: 

The European Economic Community, constituted in 1957 thanks to the Treaty of Rome, and predecessor of what we know today as the European Union, was founded to achieve a set of political and, above all, economic objectives, relegating cultural objectives to what international organizations would legislate. Nowadays it seems that nothing has changed, since the constant crises that haunt the Union —the last one, caused by the Covid-19 pandemic— seem to confirm the functionalist model that governs the EU, subordinating the capacity to create common identity bonds to immediate economic interests. This article will show the legislative path in the field of heritage and culture in the EU, where the words recently referred to will become clear, while it will be considered whether the new 2020-2030 horizon is presented as a legislative opportunity to correct this protectionist economic trend.
