RESUMEN: 

El presente artículo aborda la evolución jurisprudencial relativa a la identidad de diversos procedimientos sobre idénticos hechos en la aplicación del principio non bis in ídem por el Tribunal Europeo de Derechos Humanos desde los momentos previos al Protocolo 7 hasta la actualidad. Se exponen los criterios Engel y de la conexión suficiente hasta llegar a los nuevos problemas generados en la sentencia Mihalache contra Rumanía. Se contienen también referencias a la influencia ejercida sobre la jurisprudencia del Tribunal de Justicia de la Unión Europea.

"Identity of proceedings in the principle non bis in idem before the European Court of Human Rights"

ABSTRACT: 

This article deals with the case-law development concerning the multiplicity of proceedings about the same facts in the application of the principle non bis in ídem by the European Court of Human Rights from the time before Protocol 7 until the present day. The Engel criteria and the sufficiently close connection in substance and in time criterion up to the new problems generated by the Mihalache judgment against Romania are set out along this article. References to the influence on the case-law of the European Court of Justice are also included.
